Internet User Privacy
Sunspot, Inc. respects privacy of Internet Users and does not collect personally identifying information without the Internet User's permission.
This policy applies to the web sites owned and operated by Sunspot, Inc., a California corporation ("Sunspot").

Some terms used in this Policy are:
"Affiliate Partner" - refers to a person or organization that has entered into a Sunspot Affiliate Partner Agreement and may be compensated for a sale, lead or click by an Internet User that the Affiliate Partner has referred to a Merchant's Web site.
"Cookies" - are pieces of information stored by an Internet User's Internet browser on the user's computer.
"Internet User" - refers to a person who has access to the World Wide Web via a technology enabled device, such as personal computer, handheld, PDA, etc.
"Merchant Partner" - refers to a person or organization that has entered into a Sunspot Merchant Partner Agreement and operates a Web site that pays for a sale or lead referred by an Affiliate Partner.
Collection of Data
Sunspot does not collect identity or contact information from Internet Users to Sunspot Web Sites.
An Internet User's Internet browser sets Cookies (when enabled) that contain small amounts of data on the user's computer after a visit to any web site. Cookies assist Sunspot in tracking an Internet Users' activities beginning from an Affiliate Partner's website or subscription e-mail through a Merchant Partner's website that the Internet User links to from the Affiliate's site or e-mail. If the Internet User re-visits our Merchant Partner's site directly, Sunspot is able to continue to track the Internet User's activities on the Merchant Partner's site and reward the Affiliate Partner that referred the Internet User. Cookies themselves tell Sunspot nothing about the Internet User's personally.
Cookies are used in two stages of Sunspot tracking: when an Merchant Partner's banner image is loaded on a Web page for viewing by a Internet User and when the banner is clicked by an Internet User. The function of these Cookies is to provide Sunspot with information solely for the purpose of paying Affiliate Partners commissions when an Internet User clicks on a link, creates a lead, or makes a purchase on a Merchant Partner's Web site.
Sunspot's servers automatically generate a unique identifying number of the Internet User. No Internet User information is obtained in the generation of this unique number. Sunspot's Cookies are not used to perform "User Profiling".
Sunspot does receive and record partial e-mail addresses of the Internet User, only in circumstances where the Internet User has voluntarily provided its identity and contact information through the Merchant Partner's Web site or Affiliate Partner's Web site. This partial e-mail address does not enable Sunspot to personally identify the Internet User.
If a Web site using Sunspot's tracking technology were to provide any personally identifying information to Sunspot beyond name and/or e-mail address, Sunspot would discard that information immediately.
Disabled and Non-functioning Cookies
Sunspot does not employ any technology or means of preventing an Internet User from disabling the acceptance of a Cookie. Most Web browsers automatically accept cookies, but an Internet User's browser may be set by the user to disable this function. Some Web browsers or similar Internet navigating technology may not support (or consistently support) Cookie technology. If Cookies are disabled or the Internet User is utilizing technology that does not adequately support Cookie technology, Sunspot shall not be able to record the user's click on a Merchant Partner's link that was placed on an Affiliate Partner's Web site or within a subscription e-mail or the Internet User's subsequent activity at the Merchant Partner's Web site.
Use and Disclosure of Data
Sunspot does not sell or rent personally identifying information. Sunspot does not disclose personally identifying information to anyone that Sunspot is not authorized to do so. Sunspot uses anonymous user data to create and report the browsing, purchasing and/or lead form completion activities of anonymous users.
Sunspot reserves the right to release information on Internet Users if compelled to do so by proper judicial or governmental authorities. Disclosure shall be limited to only to those that Sunspot is compelled to disclose to. At present, all information processing occurs in the United States.
Sunspot employs industry standard security measures to ensure the security of all data. Access to Sunspot customer data is accessible via password protection through the Merchant Partner and Affiliate Partner Accounts created by each Merchant Partner and Affiliate Partner, and to designated Sunspot employees who require system level access in order to perform their jobs. Access to customer data that identifies the customer's name and/or e-mail addresses is limited to designated Sunspot employees who require such access in order to perform their jobs and to a Merchant Partner or Affiliate Partner that provided such information. Each Merchant Partner and Affiliate Partner is responsible for maintaining the confidentiality of its own password used for accessing its accounts on the Sunspot Affiliate Marketing Network.
Affiliate Partner and Merchant Privacy
Sunspot does not share with anyone other than a Merchant Partner, personally identifiable information about an Affiliate Partner, and vice versa. Such exchange is limited to a party's e-mail address and basic Account detail (including but not limited to Web site name (if applicable), date Web site or subscription e-mail first entered into operation, and Internet User demographics). Such information shall be accessible to enable each party (a Merchant Partner and an Affiliate Partner) to assess a potential affiliation with the other party and, when an affiliation has been established, to facilitate the on-going relationship. The parties may contact each other before entering into an affiliation (e.g. for the purpose of soliciting affiliation, and other similar commercial solicitations) and after an affiliation for the purpose of sending and receiving targeted commercial e-mail solicitations regarding special promotions and affiliation opportunities. Once an affiliation is established, the parties are privy to recorded information regarding the affiliation results, including anonymous Internet User transaction data for Internet Users referred by the Affiliate Partner. If an Affiliate Partner has been given permission, by the Internet User, to record personally identifiable transaction data (e.g. through rewards membership programs), the anonymous Internet User transaction data may be coded by an Affiliate Partner to enable the Affiliate Partner to generate personally identifiable Internet User transaction data. Under the foregoing circumstances, the information remains anonymous to Sunspot. By completing the registration process, Affiliate Partners and Merchant Partners agree to be solicited by Merchant Partners and Affiliate Partners (respectively) for the foregoing purposes. All other personally identifiable information of Merchant Partners and Affiliate Partners that is provided by them during the sign-up process is retained and used by Sunspot in order to serve the Affiliate Partner and the Affiliate Partner's Merchants through processes such as performance reporting and commission payments to Affiliate Partners. Merchant Partners and Affiliate Partners have agreed with Sunspot not to engage in spamming, unsolicited e-mail and indiscriminate advertising. Each Merchant Partner and Affiliate Partner may view or modify the information that it provided during sign-up.
Sunspot does not intentionally send unsolicited e-mail messages that could legitimately be construed as spam. Sunspot's Merchant Partners and Affiliate Partners are held to the same standards.
Sunspot complies with the Children's Online Privacy Protection Act of 1998. No Sunspot Web Site is specifically directed to children under 18. If you are under the age of 18, you may NOT become a Merchant Partner or Affiliate Partner of Sunspot's Affiliate Marketing Network. Merchant Partners and Affiliate Partners are also obligated to comply with COPPA.
If Sunspot has been informed or unintentionally collected or received information from a child under 18, Sunspot will immediately delete such information from its databases. Sunspot shall not knowingly distribute any personally identifiable information erroneously collected from children under 18.
Affiliate Partners and Merchants Partners Access Accounts
Please contact email@example.com if you no longer wish to maintain an account with Sunspot, or are unable to access your account. Sunspot shall not retain your name and/or e-mail address any longer than is necessary to perform the services that you requested from Sunspot.
